한특허

일반적으로 미국 특허출원은 출원한 순서대로 심사하고, 기술 분야에 따라 다르긴 하지만 요즈음에는 1st Action (OA 혹은 NOA)까지 약 3~4년의 기간이 소요됩니다.

심사를 더 빨리 진행시키기 위해 USPTO에 Petition to Make Special(PTMS)을 신청하는 것이 가능합니다. 관련 사항은 MPEP 708.02 Petition To Make Special [R-6] -700 Examination of Application에 나와있습니다.

출원일을 기준으로 다음 요건 중 하나 이상을 만족시킬 경우에만 PTMS 신청이 가능합니다.

1. 출원일: 2006년 6월 25일 이전
- Patents will enable manufacture of invention
- Patents are being infringed
- SPECIAL STATUS FOR PATENTS RELATING TO BIOTECH FILED BY SMALL ENTITY APPLICANTS
- PATENTS RELATING TO RECOMBINANT DNA, ENERGY and ENVIRONMENTAL QUALITY, or
- PATENTS RELATING TO CERTAIN AREAS
  (e.g. superconductivity, cancer, HIV/AIDS, and terrorism)

2. 출원일: 2006년 6월 25일 & After
- One of the inventors is over the age of 65 or ill
  (to the point where they may not be available to assist in the prosecution of the patent)
- PPH(Patent Prosecution Highway) Program, or
- Accelerated Examination(AE)

European Commision에서 범유럽 특허 소송 법원(Europe-wide patent court)을 만들자는 案을 냈다는 소식이 있습니다. European community 및  European Patent Convention(EPC) member 間 협의를 통해 결정될 예정입니다.

올해 안으로 대략적인 윤곽이 잡힐 것으로 보입니다. Europe-wide patent court가 생기면 최대 30개국의 특허소송을 한 곳에서 다루는 것이 가능하고, 판결이 1개국이 아닌 여러 국가에 효력을 미칠 것으로 전망합니다.
